Terms, Conditions and Acceptable Use Policy
Metanet.net provides Internet World Wide Web page hosting and e-mail
services. Metanet.net has legal and ethical responsibilities regarding
the use of its computer network and equipment involved in these
services.
Metanet.net general policy is to act as a neutral provider of access to
the global Internet. Metanet.net has specific ethical concerns regarding
the use of its computers detailed below. Metanet.net reserves the right
to suspend or cancel(at our discretion), a customer's access to any or all
services provided by Metanet.net when it has been determined that
the account has been inappropriately used.
Specific Acceptable Use Policies
At Metanet.net, we value our customers and wish to offer them the ability to use and enjoy the network and services provided by Metanet.net in the ways that help them most in their business, recreation, and family life. However, to help us offer you the best service we can, we need to set some rules that everyone will follow. These policies are intended to make the Metanet.net Service available to all our customers as consistently and efficiently as possible. While Metanet.net does not monitor your use, you are obligated to adhere to these policies. These policies are part of your terms of service agreement, and violating them means we can take appropriate action to restrict or terminate your access to the Metanet.net Service.
User-Supplied Content. Through the Metanet.net Service, you may have access to Web pages, e-mail or other services that enable you to send or post materials ("Content") and make that Content available to others. You must not submit, publish, or display on the Metanet.net Service any defamatory, inaccurate, abusive, obscene, infringing, or threatening Content, or Content that violates any federal, state, or local law. You are solely responsible for the Content you make available through the Metanet.net Service. Metanet.net is
not obligated to monitor the Metanet.net Service to examine the Content available through it. You hereby acknowledge that if Metanet.net is made aware of Content that Metanet.net deems in its sole discretion to be unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, Metanet.net has the right, but not the obligation, to edit, remove or deny access to such Content. Metanet.net may report to legal authorities any Content that is or is accused to be unlawful, and may disclose to such authority that you are the author of the Content.
Intellectual Property Rights. Material accessible to you through the Metanet.net Service may be subject to protection under the United
States or other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except as expressly permitted by
the owner of such rights, you must not use the Metanet.net Service in a manner that would infringe, violate, dilute or misappropriate any such
rights, with respect to any material which your access or receive through the Metanet.net Service. If you use a domain name in connection with the
Metanet.net Host service or similar service, you must not use that domain name in violation of the trademark, service mark, or similar
rights of any third party.
Lawful Use. You must use the Metanet.net Service only strictly in accordance with all federal, state, and local laws, ordinances, and
regulations. You may not use the Metanet.net Service to assist any other person or entity to violate any federal, state, or local laws,
ordinances, or regulations.
Netiquette. You should only use the Metanet.net Service in a manner consistent with the principles of Netiquette. You must not use the Metanet.net Service in a manner that will disrupt third parties' use or
enjoyment of the Metanet.net Service or other communications services and outlets, or use the Metanet.net Service to invade the privacy of third parties;
impersonate Metanet.net personnel; or post material in any USENET or newsgroup that is off-topic according to the charter or other public statement
of the USENET or newsgroup. You must not use the Metanet.net Service to solicit other members to patronize competing services, not to violate or
tamper with the security of the Metanet.net Service or attempt to utilize another member's account name or persona without authorization from that
member.
Unsolicited Electronic Mailings.
You must not use the Metanet.net Service, Metanet.net's equipment or any Metanet.net electronic mail address in connection with the sending of the same or substantially similar unsolicited electronic mail message, whether commercial or not, to more than one recipient on any given day. This prohibition extends to the sending of unsolicited mailings from another service which in any way implicates the use of the Metanet.net Service, Metanet.net's equipment or any Metanet.net electronic mail address. For each day on which you violate this provision, you must pay Metanet.net $500 to compensate for the damages such a violation causes to Metanet.net's good will. Metanet.net may waive all or a
portion of this charge in the event it determines your violation was
unintentional. Payment by you under this provision will not prevent Metanet.net from seeking additional legal remedies against you, including compensatory damages and/or an injunction. Metanet.netHost customers please note that Metanet.net's mail servers for the service are physically located in the state of California and Maryland. The sending of any unsolicited commercial email messages through the Metanet.net Service utilizes those mail servers and is strictly prohibited.
Storage Capacity. Your storage space and bandwidth utilization on the Metanet.net Service must remain within the Storage Space and
Bandwidth Allocations associated with the access plan you have selected. Metanet.net will provide 50 megabytes of electronic mail storage for you, and that you are responsible for ensuring that electronic mail stored by you will not exceed this limit. For Metanet.net and similar accounts, these allocations are set forth in the Key Points Memorandum above.
Traffic and Hits. If you publish any Web page or site using Metanet.net Service, the usage of that Web page or site should be consistent with the hosting plan you have chosen, as set forth in the Key Points Memorandum above. For Hosting accounts, Metanet.net may suspend, terminate access to your Web page, site or charge $6.00 per Gigabyte if Metanet.net determines that that Web page or site has, on any single month, received download traffic of
five Gigabytes (5,000,000K) or more.
Third Party Rules, Licenses, and Terms of Service. Through the Metanet.net Service, you may have access to search engines, subscription Web
services, Web pages, USENET, or other services that promulgate rules, guidelines or agreements to govern their use. You must adhere to any such rules, guidelines, or agreements. In addition, if you use any software or data in connection with or through the Metanet.net Service, you must use that software or data in accordance with any applicable license agreements.
Unauthorized use of other people's accounts or computers
Metanet.net will strongly react to any use or attempted use of an
Internet account or computer without the owner's authorization. Such
attempts include "social engineering" (tricking other people
into releasing their passwords), password cracking, security hole scanning etc.
Any unauthorized use of accounts or computers by a Metanet.net customer,
whether or not the attacked account or computer belongs to Metanet.net,
will result in action against the attacker. Possible actions include warnings,
account suspension or cancellation, and civil or criminal legal action,
according to the seriousness of the attack.
Commercial advertisements with e-mail
Unsolicited commercial advertisements are not allowed in e-mail, and
will likely result in account suspension or cancellation.
Commercial advertisements are unwelcome in most Usenet discussion groups
and on most e-mail mailing lists. Inappropriate posting may result in account
suspension or cancellation. See the newsgroup or mailing list's charter
for whether advertising is allowed or not. "Spamming," or sending
a message to many different off-topic newsgroups, is particularly unethical
and will be treated as such.
Sending a message, especially an advertisement, to more than five or six
recipients, is by itself spamming unless the individuals have specifically
requested to be added to a mailing list on that topic. E-mail is a person-to-person
medium, not a broadcast medium.
Payment Policies
All accounts are set up on a pre-pay basis. Setup fees are charged
for all new accounts and major account changes and are non-refundable.
All pricing is guaranteed for the term of pre-payment. Metanet.net
reserves the right to change prices at any time without prior written notice.
Payment is due each anniversary month or period following the date the account
was established. Credit card orders that are on a 'month-to-month', 'quarterly'
and 'yearly' basis will be charged automatically to the card number on file.
If for any reason the card does not clear with the bank on three attempts,
the account is subject to suspension. Any account not brought current within a
week of e-mail notice or exceeding this time frame in any way is subject to
suspension. The customer is responsible for all money owed on the account
from the time it was established to the time that the customer notifies
Metanet.net in writing for a request for termination of services.
Checks returned upaid (NSF) will be assessed a $10 charge. All payment is in U.S.
currency.
Cancellation
Metanet.net reserves the right to cancel service at any time. All
fees paid in advance of cancellation will not be refunded if Metanet.net
institutes its right of cancellation.
If cancellation is caused by customers violation of these policies, then no
refund is due.
Customers can cancel service any time and but will not be refunded any amount.
Due to security concerns, all account
cancellations must be done in writing via US mail or fax with a valid signature
of the primary contact of the account, account name, reason for cancellation,
and last 4 digits of credit card on file. If payment was made by check
or bank transfer, the zip/postal code of the primary contact would be required.
No Payment will be made by Metanet.net.
The account will be cancelled at the end of the current
billing period, unless a date of cancellation is specified.
Lawful Purpose
Metanet.net reserves the right to refuse service to anyone. Customers
may only use Metanet.net server for lawful purposes. Transmission of
anymaterial in violation of any Federal, State or Local regulation is prohibited.
This includes, but is not limited to copyrighted material, material legally
judged to be threatening or obscene, and material protected by trade secrets.
It is expressly forbidden for using Metanet.net servers for the
propagation, distribution, housing, processing, storing, or otherwise handling
in any way lewd, obscene, or pornographic material, or any other material which
we deem to be objectionable, including, but not limited to, pornography, satanic
materials, and any and all materials of an adult nature. The designation of
any materials as such described above is left entirely to the discretion of
Metanet.net management.
Metanet.net services are intended for the end user only. Customers
cannot sublease, subhost, or give away control of any portion of
Metanet.net resources. Doing so could result in immediate account
cancellation.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Metanet.net
harmless from any and all demands, liabilities, losses, costs and claims,
including reasonable attorney's fees asserted against Metanet.net,
its agents, its customers, officers and employees, that may arise or result
from any service provided or performed or agreed to be performed or any product
sold by customer, its agents, employees or assigns. Customer agrees to defend,
indemnify and hold harmless Metanet.net against liabilities arising out of;
(1) any injury to person or property caused by any products sold or otherwise
distributed in connection with Metanet.net server; (2) any material
supplied by customer infringing or allegedly infringing on the proprietary rights
of a third party; (3) copyright infringement and (4) any defective products
sold to customer from Metanet.net server.
Disclaimer
Metanet.net will not be responsible for any damages your business
may suffer. Metanet.net makes no warranties of any kind, expressed
nor implied for services we provide. Metanet.net disclaims any warranty
or merchantability or fitness for a particular purpose. The includes loss of
data resulting from delays, nondeliveries, wrong delivery, and any and all
service interruptions caused by Metanet.net and its employees.
Metanet.net reserves the right to revise its policies at any time
without prior notification.
